Spanish soccer player Jenni Hermoso has filed a legal complaint against Luis Rubiales, the former president of the Spanish soccer federation, accusing him of sexual assault. The allegation stems from an incident where Rubiales kissed Hermoso on the lips without her consent during the awards ceremony following the Women's World Cup final on August 20th in Sydney, Australia. Rubiales, who was subsequently suspended from his post by FIFA, contends that the kiss was consensual, while Hermoso vehemently denies it.

The prosecutors' office in Madrid has stated that, according to a sexual consent law passed last year, Rubiales could face a fine or a prison sentence ranging from one to four years if found guilty. The law eliminated the distinction between "sexual harassment" and "sexual assault," criminalizing any non-consensual sexual act.

Hermoso has received widespread support from Spain's government, players' unions, players, and citizens. Despite Rubiales' refusal to resign, he has become a pariah in the soccer community. Spain's government is also investigating Rubiales for potential abuse of authority and conduct that tarnished Spain's image.

In an August 26th speech before the federation assembly, Rubiales described the kiss as "mutual" and compared it to an affectionate gesture he could give to one of his daughters. However, Hermoso strongly refuted this claim, declaring it to be a lie. Hermoso conveyed her feelings in a statement posted on social media, saying, "I felt vulnerable and a victim of an impulse-driven, sexist, out-of-place act without any consent on my part. Simply put, I was not respected."

Hermoso's accusation represents a significant challenge to Rubiales, as it could lead to a criminal case. While FIFA can impose sanctions on individuals, including warnings, fines, and suspensions from the sport, Hermoso's legal complaint presents a more serious legal consequence for Rubiales.

Rubiales' behavior at the Women's World Cup final, combined with his controversial speech and actions, has deeply divided Spanish soccer. The firing of Spain's Women's World Cup champion team coach, Jorge Vilda, and the refusal of both women's and men's teams to play under Rubiales' leadership demonstrate the profound impact of the controversy.
